Terms and Conditions
for Recruitment Partners of Anglian College London

This document sets out simple rules for any organisation (hereafter described as “you” or the “Agent”) that assists Anglian College London (“we/us” or "ACL" or the “College”) in recruiting overseas students.  It is to be read together with the College’s Terms and Conditions for students, and with immigration rules laid down by the British government (mostly published on the UKBA website).  Some associated procedural details will be notified to you in Agents’ Newsletters.

1. Recruiting Function
Although you may often be described as our “Agent”, you have no authority to act legally on behalf of this College. We form contracts with individual students, not with any intermediary. Your role is to refer new applicants to us and to advise and assist them in their application processes. You will promote this College, find good students for us, and help us understand your part of the world. You will help students to pick suitable programmes of study, to understand complex visa rules, and to prepare them for our eligibility tests including interviews and essay-writing. You will ensure that the students you refer to us clearly understand the fact that the College will be their legal ‘sponsor’ for the duration of their visa, and that they may be in breach of UK immigration rules if they fail to abide by the College rules regarding sponsorship.

2. Reporting and Tracking Function
To satisfy the UKBA's concerns over immigration, we need to track all our applicants that we ‘sponsor’ and we insist that our recruitment partners do the same.  You must keep records of students that you refer to us, and track their status until they arrive and register at the College, sending those details to us as a weekly or a fortnightly return, or as directed by the College at the time.  We consider this your most important duty, so we may cancel our certificate immediately if we find you misleading us or being reluctant to co-operate.

3. Partnership Agreement
To become our Recruitment Partner and refer new students you must provide (and keep up to date) full details of your business: contact addresses (postal, email, telephones), legal status and ownership, membership details, names of key personnel, and what facilities you possess.  Please send copies of all documents by email in a zipped folder or on paper by post.  If you appear to be a suitable partner we will provide you with an ACL Agent's ID number (4 digits) to help us keep track of your communications.  Having read and understood the Terms and Conditions both for agents and for students, a named individual with authority to commit your business legally must then print out a copy of the Terms and Conditions for Recruitment Partners, sign it and send it to us (on paper, optionally preceded by email) to declare their consent.  Once approved by us and in place, this agreement lasts for one year from the date of your signature, and may be renewed by mutual agreement annually thereafter upon our Terms and Conditions then current.

4. Ethical Conduct and Legal Compliance
Your service to students and to us must be of high quality and complete honesty.  You must know in detail, and obey, the UK immigration rules that control student visas, and any legal requirements of your home country.  You must know what this College and this part of London can offer to students, and present that information accurately but attractively to prospective students.  You must also present prospective students' details to us accurately and efficiently.  If we have reason to believe that your ethical standards or efficiency are in any way unsatisfactory we may, without delay or notice, suspend your agreement and/or cancel it.

5. Developing the Relationship
Once signed up as our Recruitment Partner, you must earn our respect by sending us high-quality students.  You need to make sure that every student you refer to us has a genuine intention to study and must help them to stay, from the moment they submit an application, in direct contact with the College and to abide by UKBA rules.  We will not normally grant any partner exclusive rights to recruit for us in a particular area, but if it becomes clear that you are administratively efficient and are actively promoting the College, we will seek to develop a closer relationship with you and to direct our resources preferentially towards you.

6. Students’ Fee Payments
This College will not sponsor a student for a visa without receiving payment of the amount of fees requested in our Offer Letter, which may often be the full first year's tuition fees.  No matter how you may have worked in the past, “deposits” or holding students' fees until a visa is issued are not acceptable.  This policy follows naturally from three features of the Tier 4 rules: that student visa applicants must prove an ability to pay all first-year fees and maintain their lifestyles in the UK, that they must demonstrate a firm intention to study, and that the College can issue only a certain number of CAS letters a year.
